Introduction

These Standard Terms and Conditions shall manage your use of Cancer Awakens’ Holistic Health Questionnaire (HHQ) available at hhq.cancerawakens.com and hhq.stresstoswaasthya.com

By using the HHQ, you agree to accept all terms and conditions written in here. You must not use the HHQ if you disagree with any of these Standard Terms and Conditions.

Minors, people below 18 years old and persons who cannot enter into contracts under any Law for the time being in force are not allowed to use the HHQ.

Intellectual Property Rights

Cancer Awakens and/or its authorized licensors, franchisees, agents or representatives own all the intellectual property rights and materials contained in the HHQ.

You are granted limited license only for the purpose of taking the HHQ and accessing your HHQ Report.

Restrictions

You are specifically restricted from all of the following:

• Publishing any HHQ material in any media;
• Selling, sublicensing and/or otherwise commercializing any HHQ material;
• Publicly performing and/or showing any HHQ material;
• Using the HHQ in any way that is or may be damaging to  Cancer Awakens;
• Using the HHQ in any way that impacts user access to the HHQ;
• Using the HHQ contrary to applicable laws and regulations, or in any way that may cause harm to Cancer Awakens, or to any person or business entity;
• Engaging in any data mining, data harvesting, data extracting or any other similar data analytics activity in relation to the HHQ,
• Using the HHQ to engage in any advertising, marketing or promotional activity.

Access

Certain areas of the HHQ are restricted from being accessed by you, and Cancer Awakens may further restrict your access to the HHQ at any time, in absolute discretion. Any user ID, password or log-in credentials you may have for the HHQ are confidential and you must maintain confidentiality as well.

No warranties

The HHQ is provided “as is,” with all faults, and Cancer Awakens expresses no representations or warranties of any kind related to the HHQ or the materials contained within www.cancerawakens.com and www.stresstoswaasthya.com, related to the HHQ.

Medical & Non-Medical Disclaimer

While the highest professional standards have been applied to develop the HHQ and the report, these do not – directly or indirectly – replace any form of clinical diagnosis and/or treatment you may require. Nothing contained in the HHQ or the Report shall be interpreted as advising you. You are responsible for, and advised to seek appropriate medical and/or professional help to address your health and wellbeing, in all respects. Cancer Awakens assumes no responsibility for this.

Privacy & Confidentiality

Your individual responses/data will be held in strict confidence and will not be shared with third parties, or used for commercial purposes.

Data Usage

Cancer Awakens’ aim is to help the largest number of people around the world to better deal with the subjects of Stress, Immunity, Illness, Holistic Health and Wellbeing, by developing a robust and data-based body of work. Occasionally, Cancer Awakens may aggregate individual data to create broader demographic and psychographic profiles around these subjects, to improve our product and service offerings.

Limitation of liability

In no event shall Cancer Awakens, nor any of its officers, directors, employees, licensors, franchisees, agents or representatives be held liable for anything arising out of or in any way connected with your use of the HHQ.  Cancer Awakens, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of the HHQ.

Indemnification

You hereby indemnify Cancer Awakens to the fullest extent from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your use of the HHQ or the breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

Cancer Awakens is permitted to revise these Terms at any time as it sees fit, and by using www.cancerawakens.com you are expected to review these Terms on a regular basis.

Assignment

Cancer Awakens is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement

These Terms constitute the entire agreement between Cancer Awakens and you in relation to your use of the HHQ, and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with Indian laws, and you submit to the non-exclusive jurisdiction of the city, state and federal courts located in India for the resolution of any disputes.

1	I haven’t received a verification email	This can happen sometimes, due to a delay or downtime at the Mail Delivery service. Please Wait for 3-4 hours. If you still don’t receive it, you can Resend the verification email by clicking this link: https://hhq.cancerawakens.com/verify/resend Re-register using your personal email ID. We recommend this, since it protects your privacy too.
2	I see the error message “this email is already taken”	This can happen if the email ID you are trying to register with, has already been registered on our system. You can Reset your password by clicking ‘Forgot Your Password?’ to regain access to your account Create a new account by using an alternate email ID
3	I see the error message “These credentials do not match our records”	This can happen if Your password is incorrect. If you are sure that you have previously created an account, you can reset your password by Clicking ‘Forgot Password’ on the Registration page Clicking this link: https://hhq.cancerawakens.com/password/reset Your email ID is not registered on our system. You can try to register again, by clicking this link: https://hhq.cancerawakens.com/register
4	I completed the HHQ partially and logged out. Now I want to complete it, but I can’t log in again	Please email us at support@cancerawakens.com. If you can attach a screen-shot of the issue and/ or the error message you see, it will be easier and quicker for us to guide you
5.	I forgot my password	You can easily reset your password by clicking this link: https://hhq.cancerawakens.com/password/reset
6	I can’t download my report	Please email us at support@cancerawakens.com. If you can attach a screen-shot of the issue and/or the error message you see, it will be easier and quicker for us to guide you
7	My Personal Data has changed. I don’t know how to update it	Please sign-in to your Account with your user ID and Password. Click on the ‘Account’ tab The ‘Change Intake Data’ page will open Remember that many fields are editable (eg. Education, Occupation, Marital Status, etc) but others are not (eg. Name, Date of Birth, Email ID, etc) Click on ‘Save’ to complete the process If you still face trouble, please email us at support@cancerawakens.com. Ideally, please attach a screen-shot, so it will be easier and quicker for us to guide you.
